Terms and Conditions Video digitization
RUNDMAN GmbH carries out orders for video digitization exclusively on the basis of the following General Terms and Conditions (GTC). Deviating regulations will not be recognized unless they are confirmed in writing.

1. Contract
The customer is provided with the possibility to create an online order at ConvertMemoriesToDigital.com which is a part of " ConvertMemoriesToDigital.com" General Terms and Conditions (GTC). This offer is valid for four weeks from the date of generation.
By submitting or transferring the material to be secured and the signed order form and " ConvertMemoriesToDigital.com", the customer agrees to the offer concluded in contract.
Decisive for the observance of the offer period is the date of receipt of the material including the order form.
If the material arrives at the " ConvertMemoriesToDigital.com" only after expiry of the offer period, it is a binding offer on the part of the customer. This offer is accepted by " ConvertMemoriesToDigital.com" with the order confirmation.
Tapes, films and cassettes, which the customer makes available to us for the production of a sound or data carrier, may be returned after use at the expense and risk of the customer. In the case of the loss of tapes, films and cassettes, which are the property of the customer, we have to replace the material value of the lost thing, whereby we are liable only for intent and gross negligence. We do not have to replace the new production costs or any further damage. The customer is responsible for the production of backup copies.

2. Costs
If the offer period is adhered to, the fee to be paid is determined by the customer on the basis of the stated prices on the order form.
At the end of the offer period, the fee to be paid is determined by the prices of the " ConvertMemoriesToDigital.com" valid at the time the contract was concluded. All contractual fees to be paid by the customer are inclusive of the applicable statutory sales tax.

3. Delivery
The " ConvertMemoriesToDigital.com" delivers to the delivery address stated in the order. The delivery times specified by " ConvertMemoriesToDigital.com" are non-binding. The " ConvertMemoriesToDigital.com" is entitled to partial deliveries.
The shipping risk for the outward and return shipping is borne by the customer. Regardless, the " ConvertMemoriesToDigital.com" sends all mail only as insured shipment. Every commodity we ship is insured for transport. If a consignment is damaged during transport or in the case of incomplete delivery, it must be complained within 48 hours, accompanied by a written statement of facts by the freight forwarder, courier or carrier, otherwise the claim for compensation expires.

4. Warranty and defects
Defects can only be acknowledged by " ConvertMemoriesToDigital.com" if they relate to technical imperfections of the delivered goods. Taste complaints are not considered defects. The result of the work depends on the quality of the submitted materials and data. In the case of deficiencies in the delivered goods for which " ConvertMemoriesToDigital.com" is responsible, " ConvertMemoriesToDigital.com" is entitled to substitute delivery. In order to examine a complaint and to rectify it, it may be necessary for the client to provide the created data carriers as well as the originals once more. If the " ConvertMemoriesToDigital.com" does not comply with the legitimate request for a replacement delivery within a reasonable time or refuses the " ConvertMemoriesToDigital.com" the replacement or fails, the customer may demand the ineffectiveness of the order or reduce the remuneration.
The customer must take care to make backup copies of the digitized videos, as well as the delivered data carriers such as hard disks and DVDs can be damaged.

5. Data security
The " ConvertMemoriesToDigital.com" will handle the data collected (first and last name, telephone number, e-mail address, and address) in accordance with the statutory provisions of the Teleservices Data Protection Act (TDDSG) and the Federal Data Protection Act (BDSG).

6. Rights of third parties
The customer affirms that he is the sole owner of all rights (video and audio) of the source data media, in particular not to infringe the rights of third parties on the persons or objects depicted on the films / videos / image files. Insofar as third parties assert a violation of their rights to " ConvertMemoriesToDigital.com", the customer agrees to indemnify " ConvertMemoriesToDigital.com" at the latest on the first written request of all claims made against third parties against " ConvertMemoriesToDigital.com" and the " ConvertMemoriesToDigital.com" any other damages to replace, as far as the customer has to represent these.

7. Other
Should one or more of these terms and conditions be or become ineffective or unenforceable, the relevant provision shall be replaced by one that is effective, feasible and comes as close as possible to the purpose of the original provision. The remaining terms of contract remain effective.
These terms and conditions as well as the other relations of " ConvertMemoriesToDigital.com" and the customer are subject to Latvian law. The UN Sales Convention does not apply.

8. Shipping costs
The return shipment prices: EU countries - 13 EUR; International - 26 EUR.

9. Cancellation policy
The right of withdrawal applies only to consumers within the meaning of § 13 BGB (any natural person who concludes a legal transaction for a purpose that can be attributed neither their commercial nor self-employed professional activity).

The consumer can withdraw his order without stating reasons within a period of 14 days. The cancellation period begins with conclusion of contract, acc. Section 355 (2) BGB n.F. and is 14 days. The revocation period does not begin until the consumer has been informed about his right of revocation and the legal information obligations are completely fulfilled. This is the case if the consumer can view the order confirmation, the ABG and the cancellation policy before placing an order in the online shop and this after conclusion of the contract on a durable medium, e.g. via e-mail, received.

  Exercise of the Right of Withdrawal: In order to exercise your right of withdrawal, you must inform us, the " ConvertMemoriesToDigital.com" by means of a clear explanation, e.g. send a letter, fax or e-mail sent by post informing you of your decision to withdraw from this contract. The receipt of your revocation by digitalspezialist will be acknowledged in writing. You will immediately receive an acknowledgment of receipt by e-mail.

Consequences of revocation: In the case of an effective revocation, the mutually received benefits shall be returned and any benefits derived, including delivery costs (with the exception of the additional costs arising from the fact that you have a different delivery than the cheapest we offer Standard delivery), immediately and no later than 14 days from the day on which the notification of your withdrawal of this contract has been received by us. For this repayment, we use the same means of payment that you used in the original transaction, unless otherwise agreed with you; In no case will you be charged for this repayment fees.

Early termination of your right of withdrawal: Your right of revocation expires prematurely, if the contract is fulfilled at your express request partially or completely, before you have exercised your right of withdrawal. The right of withdrawal for the purchase of software expires with the opening of sealed packaging. Software and validated vouchers with opened seals / rubbing surfaces can not be returned.
